If you are using Marlin Leasing, you need to be aware of a new gimmick.
Because we aren't allowed to ship units back early, we have on occassion sold replacement equipment ahead of expiration and warehoused the old units at our office until we could get the Return Authorization. Of course this is forbidden according to the terms of the lease. Marlin is now
a.) Putting the lease into default
b.) Ignoring any communications of lease-end intentions from the customer
c.) Mandating the 12 month automatic renewal.
This is despite the fact that the proper communication was done on time!!!
We discontinued using Marlin because of lies, misrepresentations, and Breach of Contract so now they are making our customers pay in every way imaginable and even this one which I never imagined.
By the way, if any of you are working under the understanding that you have a "special arrangement" with Marlin Leasing, I would investigate that theory thoroughly. We requested a lease arrangement where-by we could waive the 12 month renewal at our option. They agreed as long as the rate could be higher in return. We agreed, they drew up the Dealer Agreement, we signed. Now, 3 years later when the first leases start coming up, they renig saying that they didn't have a copy of the agreement even though a relationship with them was not possible without the Dealer Agreement. So, we have taken a major hit on funding for 3 years in return for a concession they have no intention of giving.
