ROCHESTER, N.Y. (WHAM) - A Florida man was sentenced to 18 months in federal prison for a $25 million scheme to resell Xerox toner.
Robert Fisher, 79, was one of five men convicted in the conspiracy. Fisher pleaded guilty to conspiracy to commit wire fraud.
Prosecutors said Fisher worked with Kyle Haynes, Jason Haynes, David Haynes, and Bryan Day to set up sham companies to buy dozens of Xerox printers and order nearly $25 million in toner. RBM Imaging, which was owned by Fisher, purchased the toner. He then represented to Xerox that he sold it to one of the sham companies.
Instead of using the toner, the materials were sold for approximately about $11 million. The five men split the profits.
Under the Xerox business model, customers pay the company based on the number of prints made with its toner; payments are not made upfront.
Kyle Haynes, Jason Haynes, David Haynes, and Bryan Day were all previously convicted.
In addition to the prison sentence, Fisher was ordered to pay $3.8 million in restitution to the Xerox Corporation, and $150,000 to the IRS.
