Feds to start more enforcement

The Department of Health & Human Services (DHHS) announced it will begin enforcing “health IT information blocking” penalties on 9/1/2023

Part of the 21st Century Cures Act
Certified health IT developers and entities and health information exchanges and networks can be penalized $1 million for interfering with the access, exchange and use of electronic PHI (EHI)
Requires that patients can access structured and unstructured PHI at no cost
DHHS has NOT yet established a rule for healthcare providers
