Guam - The Office of Public Accountability has dismissed the appeal filed last month by Island Business Systems & Supplies regarding the Department of Education's failure to issue a decision on IBSS's September protest concerning copiers. The public auditor finds that she does not have the jurisdiction to hear IBSS's appeal because DOE has failed to produce a decision.
Instead, the auditor has jurisdiction to hear an appeal of a written decision from the purchasing agency, which is DOE. The auditor does however urge DOE to issue a decision saying failure to do so is an act of bad faith.
