LAKE SUCCESS, N.Y. – Canon U.S.A., Inc., a leader in digital imaging, announced today that it is pleased and satisfied with the agreed upon Consent Order that will terminate its U.S. International Trade Commission (“ITC”) proceeding against 20 Respondents, including Ninestar Image Int’l Ltd. and Zhuhai Seine Technology Co., Ltd. concerning certain toner cartridges and their photosensitive drums sold for use in Canon or Hewlett Packard laser beam printers. That Consent Order, which was approved by the Administrative Law Judge in charge of the proceeding on April 8, 2011 and is expected to be entered by the ITC about thirty-days thereafter, acknowledges the validity of the involved patent claims, and acknowledges that the Respondents may not import into the U.S. or sell in the U.S. the accused toner cartridges and their photosensitive drums without a license or consent from Canon. Canon has no present intention to grant a license to Ninestar or the other Respondents. Canon initiated its proceeding to obtain an Order from the ITC prohibiting Ninestar and the other Respondents from importing into the U.S. and selling in the U.S. the accused toner cartridges and their photosensitive drums, which is precisely what the Consent Order shall do.
Canon filed the complaint on June 28, 2010 for infringement of Canon’s U.S. Patent Nos. 5,903,803 and 6,128,454, against the following twenty (20
) Respondents:
